VIRTROPOLIS VR WAIVER AND RELEASE OF LIABILITY FORM This agreement contains a waiver of important legal rights. Please read carefully. In consideration of Even Ventures, LLC, doing business as Virtropolis VR, allowing me to participate in virtual reality experiences, including but not limited to VR escape rooms, arcade games, and related activities using Virtropolis VR’s equipment and software at its locations, I, the undersigned participant (or parent/guardian if under 18), agree to the following terms: 1. ASSUMPTION OF RISK I understand that participating in VR activities carries inherent risks, including but not limited to: Disorientation, dizziness, nausea, or motion sickness Tripping over cables or equipment Collisions with walls, objects, or other participants Malfunction of VR headsets, controllers, or tracking systems Possible minor physical contact from staff to adjust equipment or guide me to the play area for safety reasons I voluntarily assume all such risks, whether known or unknown, and understand that my awareness of the physical play area is limited while wearing VR equipment. 2. RELEASE OF LIABILITY I fully and forever waive, release, and discharge Virtropolis VR and its owners, employees, contractors, and licensors from any and all liability, claims, expenses, demands, actions, or causes of action arising out of my participation in VR activities, except in cases of gross negligence or intentional misconduct. 3. PERSONAL PROPERTY I understand that Virtropolis VR is not responsible for damage to or loss of my personal property. I agree to secure my belongings prior to participation. 4. EQUIPMENT DAMAGE RESPONSIBILITY I agree to be responsible for any accidental or malicious damage to Virtropolis VR equipment. My liability will be limited to the actual cost of repair or replacement, up to a maximum of $1,800 per device. 5. AGE REQUIREMENTS AND MINOR PARTICIPATION Participants under 18 must have this waiver signed by a parent or legal guardian. Waivers signed solely by minors are not legally binding. Virtropolis VR provides suggested age ratings for each game, but the ultimate responsibility for determining whether a game is appropriate for a minor rests solely with the parent or guardian. VR headsets are designed for users approximately 10 years and older. For safety reasons, participants must be able to properly wear the headset without modifications. Children under 10 cannot participate. 6. PHOTO/VIDEO CONSENT I understand that I may be photographed or recorded during my visit. I grant Virtropolis VR permission to use my photo, video, or likeness for promotional purposes in marketing materials, social media, or the website. My name will not be disclosed without additional consent. 7. HEALTH AND SAFETY WARNING VR participation may cause symptoms such as dizziness, nausea, or seizures. I will immediately stop use if I experience any discomfort. I have consulted my doctor if I have any serious medical conditions, am pregnant, elderly, or have an implanted medical device. I will not participate if I am under the influence of alcohol or drugs. 8. COVID-19 AND COMMUNICABLE DISEASES DISCLAIMER An inherent risk of exposure to COVID-19 or other communicable diseases exists in any public place where people are present. By visiting Virtropolis VR, I voluntarily assume all risks related to exposure. 9. GOVERNING LAW This waiver shall be governed exclusively by the laws of the State of Texas. Any disputes shall be resolved exclusively in Texas state or federal courts.
